Friends , I am your average professor, still learning daily new thoughts, new technology, adventure, including also philosophy, life planning, gardening and making my own dream project " SHAKTISHALI " Youth - Brigade.


What classes do you teach? Do you have a favourite?

Alok Sir :
For five years now I have been teaching Thermodynamics, Workshop Technology,
Production Engineering
,
for freshman students majoring in the engineering. I also teach Industrial Management mainly for final year B.E. students. This year I am also teaching Nuclear Engineering for the first time, which is for students majoring in something other than science.

At present , I am studying in M.Tech( Heat Power Engineering) at BIT Sindri.

I do not think I can say I have a favourite. Each level of these classes satisfies a different part of me.


Do you have a specific lecture style?

Alok Sir :
I definitely have a certain lecture style. I emphasize conceptual understanding rather than mechanical memorization. To that end, I try to attract the type of students to join my classes who are willing to do the "Mechanical walk" in order to understand the mystery of our universe and feel the joy that results from such understanding and appreciation.

I encourage the students who join my classes to participate in a Socratic dialog.

In a Socratic dialog, the "teacher" never answers the question directly.

Instead of giving an answer to the student's question, the teacher replies with a question until the student sees the answer him/herself, until the answer comes from the teacher who lives within the student, until the student becomes the teacher him/herself.


What are your research or other scientific interests?

Alok Sir :
During the last several years, my research has been more towards better methods of teaching and writing in science & technology and in general, how students can be more successful in maintaining sustainable happiness and real personal growth.
To that end, with the help of one of my past students, Bhawani Shankar, there is now a website with a lot of material related to
"Success in College and After College : How to Get and Stay on Course." In addition, I am starting to teach a freshman seminar with the above title every quarter. That seminar grow out of informal lectures I used to give every quarter on important topics.

My other scientific interests are in green chemistry, energy & environment etc…...

How did you get interested in life planning?

Alok Sir :
That is a good question. I feel I could write a series of books on the subject. As always is the case, any one of us suddenly can become a living spring of water from his/her life experiences. In my case, I always liked teaching and learning. I knew that from my first college years. But life circumstances caused me to drift away to work in various other work environments related to chemistry. Being so thirsty for expression and the discovery of human nature, I could not take being away from an academic teaching environment anymore. The issue became an issue of life and death; it was so strong. So I suddenly started on the new path by choosing to leave a very high-paying permanent position to take several temporary very low-paying positions. I know it sounds crazy but it happened, and it had a great impact on all the members of my family. I was very lucky to have the full support of my family.

What advice would you give a student on how best to choose a good career?

Alok Sir :
I would like to keep this answer short so anyone who reads this will always remember it.
No pain, No gain
. It is not without pain that we come to know who we are. By finding out who we are more every day, it is possible to "do" what we are. And by doing what we are, we are definitely home, gravitating effortlessly towards total success. Unfortunately, to have total success in life, inwardly and outwardly, a high GPA is not enough. To do what we love is very important but it still is not enough. Only if your personality type matches with what you are doing, where, how, when and with whom, then real success is within your reach. Therefore, I say to my students that if you want to be a success, know who you are.

Do you have any hobbies?

Alok Sir :
Yes, I have several hobbies. I love taking walks and spending time in nature. To that effect, I have gardens not only at my house but also at our College provided by the Management. I encourage my students to get gardens so they can recalibrate themselves after studying and feel good about themselves. Some of them have responded. It is a great pleasure to meet them at the gardens and see them working with the soil and the plants.

I also started to take a class on how to develop yourself with new thoughts and now I am making it from all natural components. In order to encourage my students to have hobbies, I thought of the "Natural Soap Award" as I call it. For each class I teach, at the end, the student with the highest score gets a handy Gifts selecte by me. When they come to me to pick up their award, while I am carving the "life curve" on it, I have the opportunity to tell them face to face how important it is to know themselves. I consider it very important especially for the students with high GPAs to be balanced in life. After all, most of them will end up in leadership positions and many people will be affected by their decisions. We must prepare these students the best way we can. I stress the fact that doing their work right would not be enough without considering the well being of others and our environment.

Who is your favorite scientist?

Alok Sir :
Albert Einstein is my favorite scientist, not only because of his bringing truth to science but because of his excellent personality and life values that perhaps most people are not aware of. Another reason is because of the way he spoke about our favorite person, Gandhi. "Generations to come will scarce believe that such a one as this walked the earth in flesh and blood," -Albert Einstein, in regard to Mohandas Gandhi.

Er.Alok Kumar joins the Ramgovind Institute of Technology,Koderma as a Sr. Lecturer of Mechanical Engineering in April' 07 and Koderma Mining Institute in Dec'07.

He graduated from the Islamiah Institute of Technology, Bangalore in 1997 where he was selected as one of the top ten young technocrat of Bangalore, India by the Shaktishali Foundation.

Er.Alok Kumar has earlier worked as a Sr. Lecturer for Indian Institute of Engineering , East Boring Canal Road, Patna, Bharat Institute of Aeronautics , Airport Road, Patna, Sea World Academy of Marine Technology, West Boring Canal Road, Patna ( Near Raja Pul ) in Patna, Bihar.

but no satisfactory action has been taken on my application so far.

Please provide the following information with respect to the same:

1. Is it correct statement according to AICTE Act?

· The institutions have to submit an undertaking in the prescribed format which is

available on website :http://www.aicte.ernet.in/in stating that the information provided
is “factual” and “correct” and that the Council can take appropriate action, including withdrawal of approval and appropriate legal action if found that any information provided is false.

· The decision of grant of approval is completely based on the
Compliance Report, Mandatory Disclosure, Inspection Report and other documents as mentioned in the Approval Process Handbook, submitted to concerned Regional Officer.

· The Council will carry out “Random & Surprise Visits” to ensure maintenance of

‘Norms & Standards and Quality of technical education’.

· ( Violation of Norms & Standards would lead to punitive and legal actions).
Transparency by introduction of “Mandatory Disclosure” for institutions,

which helps students and other stakeholder in making informed decisions.

· Extension of approval is based on “Compliance Report and Mandatory Disclosure”

to build “Mutual Trust & Confidence” thereby bringing a convergence in our attempts
to lead technological and socio-economic development.

If yes, then provide a copy of these rules .and what actions you have taken to ensure the above rules?

RTI Act confers right to access to information held by a Public Authority on all Citizens.

In case, you have been denied the access to information you may file Appeal / Complaint before the Central Information Commission (CIC).

When to file an Appeal

19 (1) Any person who, does not receive a decision within the time specified in sub-section (1) or clause (a) of sub-section (3) of section 7, or is aggrieved by a decision of the Central Public Information Officer or State Public Information Officer, as the case may be, may within thirty days from the expiry of such period or from the receipt of such a decision prefer an appeal to such officer who is senior in rank to the Central Public Information Officer or State Public Information Officer as the case may be, in each public authority: Provided that such officer may admit the appeal after the expiry of the period of thirty days if he or she is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.

19 (2) Where an appeal is preferred against an order made by a Central Public Information Officer or a State Public Information Officer, as the case may be, under section 11 to disclose third party information, the appeal by the concerned third party shall be made within thirty days from the date of the order.

19 (3) A second appeal against the decision under sub-section

(1) shall lie within ninety days from the date on which the decision should have been made or was actually received, with the Central Information Commission or the State Information Commission:

Provided that the Central Information Commission or the State Information Commission, as the case may be, may admit the appeal after the expiry of the period of ninety days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.

19 (4) If the decision of the Central Public Information Officer or State Public Information Officer, as the case may be, against which an appeal is preferred relates to information of a third party, the Central Information Commission or State Information Commission, as the case may be, shall give a reasonable opportunity of being heard to that third party.

19 (7) The decision of the Central Information Commission or State Information Commission, as the case may be, shall be binding.

19 (8) In its decision, the Central Information Commission or State Information Commission, as the case may be, has the power to

(a) require the public authority to take any such steps as may be necessary to secure compliance with the provisions of this Act, including

(i) by providing access to information, if so requested, in a particular form;

(ii) by appointing a Central Public Information Officer or State Public Information Officer, as the case may be;(iii) by publishing certain information or categories of information;

(iv) by making necessary changes to its practices in relation to the maintenance, management and destruction of records;

(v) by enhancing the provision of training on the right to information for its officials;

(vi) by providing it with an annual report in compliance with clause

(b) of sub-section (1) of section 4;(b) require the public authority to compensate the complainant for any loss or other detriment suffered;(c) impose any of the penalties provided under this Act;(d) reject the application.

19 (9) The Central Information Commission or State Information Commission, as the case may be, shall give notice of its decision, including any right of appeal, to the complainant and the public authority.

19 (10) The Central Information Commission or State Information Commission, as the case may be, shall decide the appeal in accordance with such procedure as may be prescribed.

Reason for seeking information are not required to be given;

Pay fees as may be prescribed (if not belonging to the below poverty line category).

48 hours for information concerning the life or liberty of a person

5 days shall be added to the above response time, in case the application for information is given to Assistant Public Information Officer.

If the interests of a third party are involved then time limit will be 40 days (maximum period + time given to the party to make representation).

Failure to provide information within the specified period is a deemed refusal.

Application fees to be prescribed which must be reasonable.

If further fees are required, then the same must be intimated in writing with calculation details of how the figure was arrived at;

Applicant can seek review of the decision on fees charged by the PIO by applying to the appropriate Appellate Authority;

No fees will be charged from people living below the poverty line

Applicant must be provided information free of cost if the PIO fails to comply with the prescribed time limit.

If it is covered by exemption from disclosure. (S.8)

1 How is the State Information Commission constituted?

  1. The State Information Commission will be constituted by the State Government through a Gazette notification. It will have one State Chief Information Commissioner (SCIC) and not more than 10 State Information Commissioners (SIC) to be appointed by the Governor.
  2. Oath of office will be administered by the Governor according to the form set out in the First Schedule.
  3. The headquarters of the State Information Commission shall be at such place as the State Government may specify. Other offices may be established in other parts of the State with the approval of the State Government.
  4. The Commission will exercise its powers without being subjected to any other authority.

2. What is the eligibility criterion and what is the process of appointment of State Chief Information Commissioner/State Information Commissioners?

The Appointments Committee will be headed by the Chief Minister. Other members include the Leader of the Opposition in the Legislative Assembly and one Cabinet Minister nominated by the Chief Minister.

The qualifications for appointment as SCIC/SIC shall be the same as that for Central Commissioners.

The salary of the State Chief Information Commissioner will be the same as that of an Election Commissioner. The salary of the State Information Commissioner will be the same as that of the Chief Secretary of the State Government. (S.15)

3 What are the powers and functions of Information Commissions?

  1. The Central Information Commission/State Information Commission has a duty to receive complaints from any person -

a)

who has not been able to submit an information request because a PIO has not been appointed ;

b)

who has been refused information that was requested;

c)

who has received no response to his/her information request within the specified time limits ;

d)

who thinks the fees charged are unreasonable ;

e)

who thinks information given is incomplete or false or misleading ;and

f)

any other matter relating to obtaining information under this law.


  1. Power to order inquiry if there are reasonable grounds.
  2. CIC/SCIC will have powers of Civil Court such as -

a)

summoning and enforcing attendance of persons, compelling them to give oral or written evidence on oath and to produce documents or things;

b)

requiring the discovery and inspection of documents;

c)

receiving evidence on affidavit ;

d)

requisitioning public records or copies from any court or office

e)

issuing summons for examination of witnesses or documents

f)

any other matter which may be prescribed.


  1. All records covered by this law (including those covered by exemptions) must be given to CIC/SCIC during inquiry for examination.
  2. Power to secure compliance of its decisions from the Public Authority includes-

a)

providing access to information in a particular form;

b)

directing the public authority to appoint a PIO/APIO where none exists;

c)

publishing information or categories of information;

d)

making necessary changes to the practices relating to management, maintenance and destruction of records ;

e)

enhancing training provision for officials on RTI;

f)

seeking an annual report from the public authority on compliance with this law;

g)

require it to compensate for any loss or other detriment suffered by the applicant ;

h)

impose penalties under this law; or

i)

Guidelines for the Officers designated as first appellate authority under the RTI Act, 2005.


The undersigned is directed to say that the Central Public Information Officer (CPIO)
of a public authority is responsible to supply correct and complete information to information seeker under the Right to Information Act, 2005 within the specified time.

It is possible that a CPIO may not act as per provisions of the Act or an applicant may not otherwise be satisfied with the decision of the CPIO.

The Act contains provision of two appeals to tide over such situations.

While the first appeal lies within the public authority itself, the second appeal lies with the Central Information Commission.

The Central Information Commission (Appeal Procedure) Rules, 2005 govern the procedure for deciding appeals by the Commission.

The First Appellate Authority is, however, required disposing off the appeals received by him in the light of the provisions of the Act and keeping in view the principles of natural justice.

A guide has been prepared for the First Appellate Authorities, a copy of which is enclosed as an Annexure.

It is expected that it would help them perform their duties effectively.

Guide for the First Appellate Authorities

It is the responsibility of the Central Public Information Officer (CPIO) of a public authority to supply correct and complete information within the specified time to any person seeking information under the RTI Act, 2005.


There are possibilities that a CPIO may not act as per provisions of the Act or an applicant may not otherwise be satisfied with the decision of the CPIO, the Act contains provision of two appeals to tide over such situations.


The first appeal lies within the public authority itself that is made to an officer designated as the First Appellate Authority by the concerned public authority.


The First Appellate Authority happens to be an officer senior in rank to the CPIO.


The Second appeal lies with the Central Information Commission.


The Central Information Commission (Appeal Procedure) Rules, 2005
Govern the procedure for deciding appeals by the Commission.


The Guidelines contained in this document are meant for the First Appellate Authorities.

In order to perform his/her duties effectively, The Appellate Authority should study the Act carefully and understand its provisions correctly.


This document explains some of the important aspects of the Act which a First Appellate Authority should, in particular, be conversant with.

What is Information?

Information is any material in any form :

It includes records, documents, memos, E-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, and data material held in any electronic form.

It also includes information relating to any private body that can be accessed by the public authority under any law for the time being in force.

Right to Information under the Act

A citizen has a right to seek such information from a public authority which is held by the public authority or which is held under its control.

This right includes inspection of work, documents and records; taking notes, extracts
Or certified copies of documents or records; and taking certified samples of material
held by the Public authority or held under the control of the public authority.

The Act gives the citizens a right to information at par with the Members of Parliament and the Members of State Legislatures.

According to the Act, the information which cannot be denied to the Parliament
or a State Legislature shall not be denied to any person.

A citizen has a right to obtain information in the form of diskettes, floppies, tapes, video cassettes or in any other electronic mode or through printouts provided such information is already stored in a computer or in any other device from which the information may be transferred to diskettes etc.

The information to the applicant should ordinarily be provided in the form in which it is sought.

However, if the supply of information sought in a particular form would disproportionately divert the resources of the public authority or may cause harm to the safety or preservation of the records, supply of information in that form may be denied.

The Act gives the right to information only to the citizens of India.

It does not make provision for giving information to Corporations, Associations, Companies etc. that are legal entities/persons, but not citizens.

However, if an application is made by an employee or office - bearer of any Corporation, Association, Company, NGO etc. indicating his name and such employee / office-bearer is a citizen of India; information may be supplied to him/her.

In such cases, it would be presumed that a citizen has sought information at the address of the Corporation etc.

Only such information is required to be supplied under the Act which already exists and
is held by the public authority or held under the control of the public authority.

It is beyond the scope of the Act to create information, or to interpret information; or to solve the problems rose by the applicants; or to furnish replies to hypothetical questions.

Information Exempted From Disclosure

Sub-section (1) of section 8 and section 9 of the Act enumerate the categories of information which is exempt from disclosure Sub-section (2) of section 8, however, provides that information exempted under sub-section (1)or exempted under the Official Secrets Act, 1923 can be disclosed if public interest in disclosure overweighs the harm to the protected interest.

Further, sub-section (3) of section 8 provides that information exempt from disclosure under sub-section(1), except as provided in clauses (a), (c) and (i) thereof, would cease to be exempted after 20 years from the date of occurrence of the related event etc.

It may be noted that section 8(3) of the Act does not require the public authorities to retain records for indefinite period.

The records should be retained as per the record retention schedule applicable to the concerned public authority.

Information generated in a file may survive in the form of an OM or a letter or in any other form even after destruction of the file/record.

The Act requires furnishing of information so available after the lapse of 20 years
Even if such information was exempt from disclosure under sub-section (l) of Section 8.

It means that the information which, in normal course, is exempt from disclosure under sub-section (1) of Section 8 of the Act would cease to be exempted
if 20 years have lapsed after occurrence of the incident to which the information relates.

However, the following types of information would continue to be exempt and
There would be no obligation, even after lapse of 20 years, to give any citizen

(i) Information disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interest of the State, relation with foreign state or lead to incitement of an offence;

(ii) Information the disclosure of which would cause a breach of privilege of
Parliament or State Legislature; or

(iii) Cabinet papers including records of deliberations of the Council of Ministers, Secretaries and other Officers subject to the conditions given in provision to
clause (i) of sub-section( 1) of Section 8 of the Act.

Right to Information Vis-à-Vis Other Acts

The RTI Act has over-riding effect vis-à-vis other laws in as much as the provisions of the RTI Act would have effect notwithstanding anything inconsistent there with contained in the Official Secrets Act, 1923, and any other law for the time being in force or in any instrument having effect by virtue of any law other than the RTI Act.

Fee for Seeking Information

An applicant, along with his application, is required to pay a sum of Rs. I0/- as
application fee in cash or by way of a demand draft or a banker's cheque or
An Indian Postal Order payable to the Accounts Officer of the public authority.

The applicant may also have to pay additional fee, as prescribed by the Right to Information
( Regulation of Fee and Cost ) Rules, 2005 for supply of Information as given below:

(a) Rupees two (Rs. 2/-) for each page (in A-4 or A-3 size paper) created or Copied;

(b) Actual charge or cost price of a copy in larger size paper;

(c) Actual cost or price for samples or models;

(d) For inspection of records, no fee for the first hour; and a fee of rupees five (Rs.5/-) for each subsequent hour (or fraction thereof);

(e) For information provided in diskette or floppy Rupees fifty (Rs.50/-) per Diskette or floppy; and

(f) For information provided in printed form at the price fixed for such publication or
rupees two per page of photocopy for extracts from the publication.

If the applicant belongs to Below Poverty Line (BPL category), he/she is not required to pay any fee.

However, he/she should submit a proof in support of his/her claim to belong to the
Below Poverty line.

The application not accompanied by the prescribed fee of Rs.l 0/- or proof of the applicant's belonging to Below Poverty Line, as the case may be, shall not be a valid application
Under the Act and, therefore, does not entitle the applicant to get information.

It may be noted that where the CPIO decides that the information shall be provided on payment of fee in addition to the application fee, the CPIO is required, inter-alias, to
Inform the applicant:
(i) The details of further fees required to be paid;
(ii) The calculations made to arrive at the amount of fees asked for;

Contents and Format of Application

An applicant making request for information is not required to give any reason for requesting the information or any other personal details except those that may be necessary for contacting him.

Also, the Act or the Rules do not prescribe any format of application for seeking Information.

Therefore, the applicant should not be asked to give justification for seeking information or to give details of his job etc. or to submit application in any particular form.

Transfer of Application

If the subject matter of the application concerns any other public authority, it should be transferred to that public authority.

If only a part of the application concerns the other public authority,a copy of the application may be sent to that public authority, clearly specifying the part which relates to that public authority.
While transferring the application or sending a copy thereof, the concerned public authority should be informed that the application fee has been received.

The applicant should also be informed about the transfer of his application and the particulars of the public authority to which the application or a copy thereof has been sent.

18. Transfer of application or part there of as the case may be should be made as soon as possible
and in any case within five days from the date of receipt of the application.

If a CPIO transfers an application after five days from the receipt of the application,
He would be responsible for delay in disposing of the application to the extent of number of days that he takes in transferring the application beyond 5 days.

The CPIO of the public authority to whom the application is transferred, should not refuse acceptance of transfer of the application on the ground that it was not transferred to him within 5 days.

A public authority may designate as many CPIOs for it, as it may deem necessary.

It is possible that in a public authority with more than one CPIO, an application is received by the CPIO other than the concerned CPIO.

In such a case, the CPIO receiving the application should transfer it to the concerned CPIO immediately, preferably the same day.

Time period of five days for transfer of the application applies only when the application is transferred from one public authority to another public authority and not for transfer from one CPIO to another in the same public authority.

Supply of Information

The answering CPIO should check whether the information sought or apart thereof is exempt from disclosure under section 8 or Section 9 of the Act.

Request in respect of the part of the application that is so exempt may be rejected and rest of the information should be provided immediately or after receipt of additional fees, as the case may be.

Supply of Part Information by Severance

Where a request is received for access to information which is exempt from disclosure but a part of which is not exempt and such part can be severed in such a way that the severed part does not contain exempt information then, access to that part of the information/record may be provided to the applicant.

Where access is granted to a part of the record in such a way, the Central Public Information Officer should inform the applicant that the information asked for is exempt from disclosure and that only part of the record is being provided, after severance, which is not exempt from disclosure.

While doing so, he should give the reasons for the decision, including any findings on any material question of fact, referring to the material on which those findings were based.

The CPIO should take the approval of appropriate authority before supply of information in such a case and should inform the name and designation of the person giving the decision to the applicant also.


Time Period for Supply of Information

The CPIO should supply the information within thirty days of the receipt of the request.

Where the information sought for concerns the life or liberty of a person, the same should be provided within forty-eight hours of the receipt of the request.

Every public authority is required to designate an officer at each sub-divisional level or other sub-district level as a Central Assistant Public Information Officer (CPAIO) to receive the applications or appeals under the Act for forwarding the same to the Central Public Information Officer or the first Appellate Authority or the Central Information Commission, as the case may be.

If request for information is received through the CAPIO, the information may be provided Within 35 days of receipt of application by the CAPIO in normal course and
48 hours plus 5 days in case the information sought concerns the life or liberty of a person.

In case of an application transferred from one public authority to another public authority reply should be provided by the concerned public authority within 30 days of the receipt of the application by that public authority in normal course and within 48 hours in case the information sought concerns the life or liberty of a person.

The Central Public Information Officers of the intelligence and security organisations specified in the Second Schedule of the Act may receive applications seeking information pertaining to allegations of corruption and human rights violations. Information in respect of allegations of violation of Human Rights, which is provided only after the approval of the Central Information Commission, should be provided within forty-five days from the date of the receipt of request. Time limit prescribed for supplying information in regard to allegations of corruption is the same as in other cases.

Where the applicant is asked to pay additional fee, the period intervening between the dispatch of the intimation about payment of fee and the payment of fee by the applicant shall be excluded for the purpose of calculating the period of reply.

The following table shows the maximum time that may be taken to dispose off the applications in different situations:

1. Supply of information in normal course - within 30 days

2. Supply of information if it concerns the life or liberty of a person- within 48 hours.

3. Supply of information if the application is received through CAPIO. 05 days shall be added more; within 35 days.

4. Supply of information if application/ request is received after transfer from another public authority in case the information concerns the life or liberty of a person authority.

Within 48 hours of receipt of the application by the concerned public authority.

Also, Supply of information by organizations specified in the Second Schedule, more 05 days shall be added; within 35 days.

(a) If information relates to violation of human rights of application - 45 days from the receipt of application.

(b) In case information relates to allegations - within 30 days of the receipt of application for supply of information if it relates to third should be provided after party and the third party has treated it as following the procedure confidential given in Para 32 to 36 of these guidelines.



Supply of information where the applicant is the period intervening asked to pay additional fee

Between informing the applicant about additional fee and the payment of fee by the applicant shall be excluded for calculating the period of reply.

The prescribed period, the Central Public Information Officer shall be deemed to have refused the request.

It is pertinent to note that if a public authority fails to comply with the specified time limit, The information to the concerned applicant would have to be provided free of charge.


First Appeal

The information sought by an applicant should either be supplied to him or his application should be rejected within the time prescribed by the Act.

If additional fee need be charged from the applicant, communication in this regard should be sent to him within the time limit prescribed for sending information.

If the applicant does not receive information or decision about rejection of request or communication about payment of additional fee within the specified time, he can make an appeal to the First Appellate Authority.

Appeal can also be made if the applicant is aggrieved by the decision of the CPIO regarding supply of information or the quantum of fee decided by the CPIO.

Appeal in relation to Third Party Information

Third party in relation to the Act means a person other than the citizen who has made request for information. Any public authority other than the public authority to whom the request has been made shall also be included in the definition of third party.

It may be noted that information including commercial confidence, trade secrets or
Intellectual property, the disclosure of which would harm the competitive position of a Third party is exempt from disclosure.
Section 8(1) (d) requires that such information should not be disclosed unless the competent authority is satisfied that larger public interest warrants the disclosure of such information.
If an applicant seeks any information which relates to or has been supplied by a third party and that third party has treated that information as confidential, the Central Public Information Officer should consider whether the information should be disclosed or not.

The guiding principle in such cases should be that except in the case of trade or commercial secrets protected by law, disclosure may be allowed if the public interest in disclosure outweighs in importance any possible harm or injury to the interests of such third party.

However, procedure as given below should be followed before disclosing such information.

It may be noted that this procedure need be followed only when the third party has treated the information as confidential.

If the CPIO intends to disclose the information, he should within five days from the receipt of the application, give a written notice to the third party that the information has been sought by the applicant under the RTI Act and that he intends to disclose the information.

He should request the third party to make a submission in writing or orally, regarding whether the information should be disclosed.

The third party should be given a time of ten days, from the date of receipt of the notice by him, to make representation against the proposed disclosure, if any.

The Central Public Information Officer should make a decision regarding disclosure of the information keeping in view the submission of the third party.

Such a decision should be taken within forty days from the receipt of the request for information.

After taking the decision, the CPIO should give a notice of his decision to the third party in writing.

The notice given to the third party should include a statement that the third party is entitled to prefer an appeal under section 19 against the decision.

The third party can prefer an appeal to the First Appellate Authority against the decision made by the Central Public Information Officer within thirty days from the date of the receipt of notice.

If not satisfied with the decision of the First Appellate Authority, the third party can prefer the second appeal to the Central Information Commission.

If an appeal has been filed by the third party against the decision of the CPIO to disclose the third party information, the information should not be disclosed till the appeal is decided.

Time Limit for Filing of First Appeal

The first appeal may be made within 30 days from the date of expiry of the prescribed period or from the receipt of communication from the CPIO.

If the First Appellate Authority is satisfied that the appellant was prevented by sufficient cause from filing the appeal, the appeal may be admitted after 30 days also.

Disposal of Appeal

Deciding appeals under the RTI Act is a quasi-judicial function.

It is, therefore, necessary that the appellate authority should see to it that the
Justice is not only done but it should also appear to have been done.

In order to do so, the order passed by the appellate authority should be a speaking order giving justification for the decision arrived at.

Time Limit for Disposal of Appeal

The appeal should be disposed off within 30 days of receipt of the appeal.

In exception cases, the Appellate Authority may take 45 days for its disposal.

However, in cases where disposal of appeal takes more than 30 days, The
Appellate Authority should record in writing the reasons for such delay.

If an appellate authority comes to a conclusion that the appellant should be supplied information in addition to what has been supplied to him by the CPIO,

He may either
(i) pass an order directing the CPIO to give such information to the appellant; or
(ii) He himself may give information to the appellant while disposing off the appeal.

In the first case the appellate authority should ensure that the information ordered by him to be supplied is supplied to the appellant immediately.

It would, however, be better if the appellate authority chooses the second course of action and
He himself furnishes the information along with the order passed by him in the matter.

If, in any case, the CPIO does not implement the order passed by the appellate authority and
The appellate authority feels that intervention of higher authority is required to get his order implemented; he should bring the matter to the notice of the officer in the public authority competent to take action against the CPIO.

Such competent officer shall take necessary action so as to ensure implementation of the provisions of the RTI Act

Right to Information Act 2005

With the passage of the Right to Information Bill 2005 by the Rajya Sabha on May 12, 2005 India is now one of the 55 countries, which have legislated comprehensive laws that protect the citizens' right to information. Nine States namely, Delhi, Maharashtra, Tamil Nadu, Rajasthan, Karnataka, Jammu & Kashmir, Assam, Goa, and Madhya Pradesh already have laws on the right to information to show their commitment for building a dynamic and prosperous society by involving the people in governance and decision making process. The Supreme Court of India has, from time to time, interpreted Article 19, which upholds the right to freedom of speech and expression, to implicitly include the right to receive and impart information. There had been relentless efforts and mass mobilization in favour of a comprehensive Central Act providing access to information regimes. The new legislation is a radical improvement on the relatively weak and ineffective statute it seeks to replace, the Freedom of Information Act, 2002. The new legislation unequivocally confers on all citizens the right to access information and, correspondingly, makes the dissemination of such information an obligation for all public authorities. It is an Act, which provides for setting out the practical regime of right to information for citizens to secure access to information under the control of public authorities, in order to promote transparency and accountability in the working of every public authority, the constitution of a Central Information Commission and State Information Commissions and for matters connected therewith or incidental thereto. An outstanding feature of the Bill is the provision for Information Commissions - independent high level bodies at both the Central and State levels that are dedicated to encouraging the citizen's right to know and enforcing the provisions of the Act. By empowering these Commissions to act as appellate authorities and by vesting them with the powers of a civil court, these bodies have been given the teeth to discourage public authorities from refusing to part with information. The provisions of the Act require authorities to respond to queries in as little as 48 hours, if it is a matter of life and liberty. This will undoubtedly prompt accountability and transparency to climb up several notches, especially as the Act promises hefty fines and disciplinary action against erring officials


RTI Complaint & Appeal:
The Government of India always lays emphasis on making the lives of its citizens easy, smooth and making India truly democratic and keeping this in mind the RTI Act has been established.
RTI stands for Right To Information and has been given the status of a fundamental right under Article 19(1) of the Constitution. Article 19 (1) under which every citizen has freedom of speech and expression and have the right to know how the government works, what role does it play, what are its functions and so on.
Since every citizen pays taxes, thus this gives them more power and the right to know how their money is being spent. Right to Information Act empowers every citizen to ask any questions from the Government or seek any information, take notes, extracts or certified copies of documents or records, take certified samples of material.
The RTI Act extends to the whole of India (except the State of Jammu and Kashmir), all bodies, which come under Government notification including NGOs, which are owned, controlled or are substantially financed by the Government.
RTI Act confers right to access to information held by a Public Authority. In case,you have been denied the access to information you may file Appeal / Complaint before the Central Information Commission (CIC) using the following options:

When to file an Appeal
19 (1) Any person who, does not receive a decision within the time specified in sub-section (1) or clause (a) of sub-section (3) of section 7, or is aggrieved by a decision of the Central Public Information Officer or State Public Information Officer, as the case may be, may within thirty days from the expiry of such period or from the receipt of such a decision prefer an appeal to such officer who is senior in rank to the Central Public Information Officer or State Public Information Officer as the case may be, in each public authority:






Provided that such officer may admit the appeal after the expiry of the period of thirty days if he or she is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.






19 (2) Where an appeal is preferred against an order made by a Central Public Information Officer or a State Public Information Officer, as the case may be, under section 11 to disclose third party information, the appeal by the concerned third party shall be made within thirty days from the date of the order.






19 (3) A second appeal against the decision under sub-section (1) shall lie within ninety days from the date on which the decision should have been made or was actually received, with the Central Information Commission or the State Information Commission:






Provided that the Central Information Commission or the State Information Commission, as the case may be, may admit the appeal after the expiry of the period of ninety days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.






19 (4) If the decision of the Central Public Information Officer or State Public Information Officer, as the case may be, against which an appeal is preferred relates to information of a third party, the Central Information Commission or State Information Commission, as the case may be, shall give a reasonable opportunity of being heard to that third party.






19 (7) The decision of the Central Information Commission or State Information Commission, as the case may be, shall be binding.






19 (8) In its decision, the Central Information Commission or State Information Commission, as the case may be, has the power to






(a) require the public authority to take any such steps as may be necessary to secure compliance with the provisions of this Act, including






(i) by providing access to information, if so requested, in a particular form;






(ii) by appointing a Central Public Information Officer or State Public Information Officer, as the case may be;






(iii) by publishing certain information or categories of information;






(iv) by making necessary changes to its practices in relation to the maintenance, management and destruction of records;






(v) by enhancing the provision of training on the right to information for its officials;






(vi) by providing it with an annual report in compliance with clause (b) of sub-section (1) of section 4;






(b) require the public authority to compensate the complainant for any loss or other detriment suffered;






(c) impose any of the penalties provided under this Act;






(d) reject the application.






19 (9) The Central Information Commission or State Information Commission, as the case may be, shall give notice of its decision, including any right of appeal, to the complainant and the public authority.






19 (10) The Central Information Commission or State Information Commission, as the case may be, shall decide the appeal in accordance with such procedure as may be prescribed.

Objectives
The State Government has decided to take the following steps for improvement in science and technology education both in qualitative and quantitative terms -
To complete the construction and establishment of four Engineering Colleges in the Government sector at Ramgarh, Chaibasa Dumka & Deoghar.
The Construction work commenced during 2007-08.
To mobilize private sector investments through invitation of Expression of Interest and making available the necessary Government infrastructure on approved terms. On the basis of the invitation of the EOI, (06) six nos. of proposed Institutions [(05) five Engineering Colleges plus (01) one Polytechnic)] have already been recommended for consideration for approval by the AICTE.
Efforts are being made to mobilize joint sector collaboration with public sector/ private sector undertakings/ industries, in particular with Vinova Bhave University, SAIL. XLRI, NIFFT for the purpose of setting up Engineering, Management Colleges/ Polytechnics in the joint sector.
Sustained efforts will be made to facilitate setting up of Engineering Colleges by renowned private sector investors, who are already engaged in this field in other States.
As a measure of quality improvement, the State has taken steps to bring about improvement in the functioning of the existing technical Institutions in the Government Sector. A study has already been entrusted to XLRI to undertake evaluation of the existing Polytechnics with the objective of substantially augmenting their level of functioning and taken up formulation of TEQIP Phase-II Programme on that basis.
BIT, Sindri has already been covered in the TEQIP Programme under the World Bank Project. Steps have been initiated for improving the functioning of the Engineering College in the Government sector by providing greater autonomy, creating additional infrastructure facilities and induction and in-service training programmes for the faculty and various other steps under the Projects.
The college has already introduced the semester system and obtained NBA accreditation in most branches. It is proposed to remodel the College and a project will be formulated to enable it to achieve the deemed University status.
Curriculum of the Polytechnics has been revised in consultation with NITTTR and the new curriculum which is more focused towards current needs and aspirations will be introduced from the next financial year.
Five new Women's Industrial Schools are proposed to be set up with focus on vocational education for women.
Vocational education programmes have already been taken up in the Polytechnics under the control of the Government.
It will be ensured that Polytechnic education in Jharkhand is strongly linked to vocational training programmes for the weaker sections and women as well as community development programmes.
Setting-up of a Technical University for the State of Jharkhand not only to affiliate higher technical Institutes but also to set up Departments, Colleges, and Centers of advanced Study etc.
